CL isn’t occ immune, if we trust Frost to not be invoker the better play might be to have Frost occupy Dat, thus guaranteeing that if they are CL they can’t do anything, while Kyo jails someone else.

…then again I’m not sure that’s particularly much better from a PoE perspective than just jailexeing Dat and occupying whoever would be jailed.

The optimal play for you is to frame Dat anyways, I’m pretty sure BD still has numbers (particularly if we lynch the NK today) and thus you should frame the person who’s the easiest mark.
