He does this as town and I have experienced it firsthand. On the contrary, he was not acting like this in Clash of Cults, where he was starting groupscum. You were in that game as well, which means you also witnessed it firsthand.

If Derps wants to lynch Marshal and townreads Kyo, it doesn’t automatically make him scum. Marshal has been continuously scumreading almost all of the people on his wagon, flip-flopping and changing his mind. I don’t know if it comes from scum or town, it feels like towny desperation to me but jcnfkfm.
