I literally have no idea what to believe anymore it seems like people have literally told me 3 different things about how this works

and it’s likely none of them actually know

I’ll give you an example.

The Sonic franchise is a trademark of Sega, so if say a studio made a game with a hedgehog that ran a supersonic speeds and named it Sonic, they’d be infringing Sega’s trademark.

Sprites in Sonic games are copyrighted by Sega, so if a studio made a game without hedgehogs or rings, or anything and they used a sprite, such as a loop, from that game, they’d be infringing Sega’s copyright.

Each of them protects a different thing.

Intellectual property is an umbrella term. Trade secrets, patents, copyright, trademarks, and whatnot are all classified as IP.

copyrights are placed through Bureaucracy™ and i’m pretty sure the same with trademarks
and copyrights can’t be pressed under fair use laws or if what’s being disputed involves zero cash (the latter i’m not entirely confident on)

Also Eevee can’t sue xBlade for you/Chloe/Dat/Geyde infringing his trademark.

That’d be like if someone made a fake McDonalds restaurant, advertised their business on Facebook, and the actual McDonalds tried to sue Facebook for it. i42 forums are basically just a platform and thus would be protected under Section 230.

Not exactly. Just because the game is F2P doesn’t mean that it’s automatically covered by the Fair Use doctrine.

CFM3 was an original take with its own custom rolecards and designs

isn’t it also a series though

speaking in the general case rather than the specific one copyright can still apply even if no cash is involved

for example, if my mom publishes a book, and Alice buys a copy, scans all the pages, and posts it on the forums for free, Alice is still breaking the law
