It’s not too surprising ToL is lax on this as talking about the ongoing games is a social mechanic that fosters a community, which games need to survive.
It’s also a quasi replacement for deadchat being gone.
Basically ToL is less competive, so mild unfairness is okay if it helps community bonds. That’s my take on it.
Doesn’t work for FM, because there is a bigger investment, so unfairness is magnified and perceived as worse.

priestess this isn’t like me sitting next to a friend at school giving him advice in hearthstone, because the whole premise of mafia is that it’s a single person in each slot, or at the very least a hydra with known parts
anything otherwise basically ruins the fun. if you cannot silence somebody by stabbing them, what’s the point? and what if you don’t know how many actual heads you’re stabbing, and that person has figured out a hell of a lot more than you’d think in their personal teamchat. that’s a fair dynamic in team mafia or in hydra games, but not in a game where it’s supposed to be one player to a slot, no exceptions

It’s against the rules, explicitly supposed to test them, and even though you may not have a hard-confirmed list of the answers it still completely devalues the test
